Ben Gethi Sentenced to 5 Years in Jail for Forging Documents to Win KSh 105M IEBC Tender

The man adversely mentioned in the National Youth Service (NYS) Scandal part one Ben Gethi and his co-accused in an Independent Electoral and Boundaries Commission (IEBC) case has been sentenced to five years in jail.

Gethi and Makena can alternatively pay a fine of KSh 4 million in the matter in which they were found guilty of forging election materials tender documents. 

An Anti-Corruption Court convicted the two and other IEBC officials over the forgery of the 2013 Independent Electoral and Boundaries Commission (IEBC) election tender. 

Milimani Chief Magistrate Lawrence Mugambi slapped them with the sentence saying evidence produced in court proved the two were masterminds behind the fraud.

He also ordered three former officials at IEBC to serve one year in prison or pay fines ranging between KSh 200,000 and KSh 1 million.

While convicting the IEBC officials, Mugambi said they hatched a plot to alter the tender documents for selfish gains. 

Kennedy Ochae, Gabriel Mutunga, Willy Kamanga were convicted for careless failure to the law relating to procurement, forgery and uttering a false document. 

The Magistrate' also said that they altered tender documents to read KSh 105 million after the KSh 127 million bid they offered was higher than their competitor Konnexions Ltd which had offered a bid of KSh 107 million.

Mugambi stated that the accused persons didn’t benefit from the public funds as the public Procurement and Review Board curtailed the plans they mooted. 

Gethi and Makena were convicted for the offences forgery tax compliance certificate issued by the Assistant Commissioner of the domestic tax department at the Kenya Revenue Authority (KRA).

He singled out Mutunga for incorporating in h newly employed Kennedy Ochae into signing the doctored tender documents way after the initial opening of tender documents.

The Magistrate, however, acquitted former IEBC clerks Adan Katello Adano and Abdi Elena Ali for lack of evidence.

Mugambi stated that the accused persons didn’t benefit from the public funds as the plans they mooted were curtailed by the public Procurement and Review Board. 

He explained that no money was lost that could attract stiffer sentences or fines.
