Jimi Wanjigi Obtains Order Barring His Arrest, Prosecution

The High Court in Nairobi has issued an order restricting the Office of Director of Public Prosecutions (ODPP) from preferring criminal charges against businessman Jimi Wanjingi and his Wife Irene Nzisa. 

A warrant of arrest had earlier been issued against Wanjigi, his wife and six others who were faulted for failing to show up in court for plea taking in a land title forgery case. 

However, Wanjigi and his wife sued the Inspector General of Police, DCI and the ODPP, who have all been listed as the respondents in the case. 

The conservatory order had explicitly barred the IG and DPP who are listed first and second respondents respectively from arresting and instituting charges against the accused persons.

Sanctioning the order on Tuesday, January 18, Justice Anthony Mrima of the Constitutional and Human Rights Division barred the state agencies from effecting arrest and prosecution of Wanjigi and his wife until their case is heard and determined.

Following Wanjigi and Nzisa's application, the case was slated for a mention on February 9, 2022. 

"Pending the inter-partes hearing of the Notice of Motion, a conservatory order be and is hereby issued restraining the arrest and preference of any criminal charges against any of the petitioners in reference to the pracel of land. It is hereby ordered that this matter will be listed for directions on February 9, 2022," partly reads Justice Mrima's ruling.
